This warranty gives you specific rights as a consumer, you may already have other rights which are reflected in the laws of your country, province or state. In some countries, provinces or states, consumer laws may impose a minimum warranty period. Except as permitted by law, MÏL does not exclude, limit or suspend other rights you may have. To fully understand your rights, we recommend that you consult the applicable laws of your country, province or state.
In order to exercise the guarantee service, it is essential to present documentary evidence of the date of delivery and/or purchase of the product, either the invoice or the purchase receipt. Documents that have been manipulated or falsified will not be accepted.
The consumer must inform The MÏL of the lack of conformity (defect) within 48 hours of becoming aware of it. Failure to comply with this deadline will not result in the loss of the corresponding right of withdrawal.
The legal guarantee covers, the replacement of the product as a consequence of the lack of conformity (defect) of the product and, in this case, these will be free for the consumer. The replacement will suspend the calculation of the legal guarantee period, and in no case will it give rise to a new two-year guarantee period from the delivery of the replaced product.
This contractual Warranty applies only to The MÏL Products ("Product") as originally supplied and does not apply to any software or other equipment owned by MÏL or third parties for which end user licence agreements or separate warranty statements or exclusions are offered or intended to be applied.
LIMITED PRODUCT WARRANTY.
Notwithstanding the statutory warranty, the duration and conditions of which are stipulated by the local laws of each country, province or state, The MÏL voluntarily warrants to the original purchaser that your The MÏL Product will be free from defects in materials and workmanship under normal use during the warranty period.
Except as otherwise provided by applicable law, the warranty lasts and is given for two (2) years for the main unit, six (6) months for the battery, charger cable and straps originally packaged with the product. The limited warranty period shall be computed from the date of original purchase.
The MÏL does not guarantee that the use of the Product will be uninterrupted or error-free.
WHAT DOES THIS GUARANTEE COVER?
If a hardware defect is found in The MÏL Product and a valid request is received within the warranty period, The MÏL may:
(1) Replace the Product or one of its damaged parts
(2) Refund the Price of the Product excluding possible shipping costs.
In the event of defects, and to the full extent permitted by law, these are the only and exclusive compensatory measures. Shipping and handling charges may apply, except where prohibited by applicable law.
Any replaced hardware product will be warranted for the remainder of the original warranty period or for thirty (30) days, whichever is longer, or for any additional period of time that may apply in your jurisdiction.
HOW TO OBTAIN WARRANTY SERVICE
The MÏL can ask the client to present a proof of the details of the purchase.
WHAT IS NOT COVERED BY THIS GUARANTEE?
This Guarantee does not apply:
1- To consumable parts such as batteries, charger cable, straps or coating whose wear and tear has been foreseen over time. Unless the failure has occurred as a result of a defect in materials or workmanship.
2- To damage to the appearance of the Product, including but not limited to scratches, dents, broken glass, broken screens or broken plastic.
3- To any damage caused by use with products other than The MÏL.
4- To any damage caused by an accident, damage caused by natural disasters, abuse or misuse, contact with liquids, rain, extreme humidity or heavy sweating, sand, dirt, high temperatures, food, chemicals, extreme temperatures, fire, earthquake or any other external cause. (Example: you have detected that the strap does not close properly and you continue to wear the watch with this defect and finally the watch falls off your hand and breaks the crystal or another part of the watch. This damage is not covered by the warranty, as it is a misuse of the watch).
5- To damage caused by using the Product outside the permitted or foreseen uses described by The MÏL, or with an incorrect voltage or power supply.
6- To any damage derived from services (repair, updating or improvements) carried out by a third party other than The MÏL. Broken seals or seals that show evidence of having been tampered with.
7- To alterations or modifications of any part of the The MÏL Product; without the written authorisation of The MÏL.
8. Defects caused by normal daily use or derived from the normal wear and tear of The MÏL Product.
9- To the damaged product due to not following the instructions related to the use of the Product, or if any serial number of The MÏL Product has been removed or deleted.
10- To the use of the product for commercial purposes or to subject the product to abnormal use or conditions.
Recovery and reinstallation of software programs and user data are not covered by this Limited Warranty.
Products that were not properly imported, not properly manufactured by MÏL and/or not purchased from The MÏL are not covered by this Warranty.
Limitation of liability
This Limited Warranty constitutes your sole warranty, in substitution of any other warranty, expressed or implied, and in any case within the limits of applicable law. The MÏL shall not be liable for any special, incidental, punitive or consequential damages, including but not limited to, loss of expected profits, loss of data, loss of use, capital costs, costs of replacement of equipment or facilities, claims of third parties, damage to property arising out of the purchase or use of the item, or arising out of breach of warranty, breach of contract, negligence, tort or any analogous or equivalent legal theory, even if MÏL knew of the possibility of such damages. MÏL is not responsible for the delay caused in the provision of the services covered by the guarantee.
